Terms and Conditions
These terms and conditions are governed by the Consumer Protection Act (Official Gazette 42/14, 110/15), Chapter III – Off-premises contracts and distance contracts, Articles 57 to 79.
GENERAL TERMS
Seller
The Seller is Handmade Corner by Lucy, a design, production and retail business, owner Anita Jurić, OIB 16238118224, Oko sv.Kaje 16, 21210 Solin.
Buyer
The Buyer is a visitor to the web shop who selects at least one product, adds it to the cart, pays and sends the order to the Seller, or sends the order and pays for the product cash on delivery.
Photos and descriptions
Product photos may not be completely identical (color, fabric texture, etc.), as this is affected by the conditions in which the products were photographed. In the product descriptions we try to state the product characteristics as accurately as possible. We reserve the right to errors in product descriptions and images. Additional product information can be obtained by email.
Product features and prices
The main product features are listed on the Handmade Corner by Lucy web shop. All prices published on the web shop are listed without shipping costs, which the Buyer will be informed of during the ordering process, as they depend on the size and number of shipments sent. Pursuant to Article 90, paragraphs 1 and 2 of the VAT Act (Official Gazette 73/13, 99/13, 148/13, 153/13, 143/14, 115/16), VAT is not added to the prices. All prices are in USD. If, due to an error or oversight, a price published on the “Handmade Corner by Lucy” web shop is incorrect or has changed in the meantime, the Handmade Corner by Lucy business reserves the right to change it, and in that case will inform the Buyer of the change or correction of the price and allow them to cancel their order if they wish.
Product delivery
Products are delivered no later than 15 days from the date of the confirmed and paid order. Products are delivered by courier services to the Buyer's address. If the Buyer has ordered several products and some of them are available for earlier delivery, the Buyer will be notified and can choose whether to receive those products earlier, separately from the rest of the order. If the ordered products cannot be delivered for any reason, the Seller will offer the Buyer the most similar product and, with the Buyer's consent, proceed with delivery as described above. If the offer does not suit the Buyer, we will refund the amount paid.
If a product cannot be delivered within the agreed time, primarily due to delays caused by a third party, supplier or courier, the Seller reserves the right to unilaterally terminate the contract and refund the total amount paid to the Buyer's account, without default interest. Handmade Corner by Lucy is not liable for damages resulting from the inability to fulfill the contract.
Liability for material defects and warranty
If the Buyer receives a damaged or defective product, they should notify the Handmade Corner by Lucy business of the damage as soon as possible at the email address or phone number given above, and the product will be replaced at the expense of the Handmade Corner by Lucy business. Material defects do not include product characteristics relating to design, shape or color. The Handmade Corner by Lucy business is not liable for damage that occurs during transport, and the Buyer is obliged to check whether the packages show any signs that might indicate damage to the products.
Dispute resolution
The contracting parties will endeavor to resolve all disputes amicably and out of court, in good faith. Otherwise, they agree to the jurisdiction of the court at the defendant's place of residence or registered office.
Payment methods
Payment in the Handmade Corner by Lucy web shop can be made cash on delivery, by direct bank transfer (online banking or payment slip) or via PayPal. When paying by e-banking or payment slip, payment and/or interbank transaction fees are not included in the price. If the Buyer orders a product and refuses to accept it, the Seller has the right to ask the Buyer to reimburse postage and the Seller's own handling costs.
Complaints
Pursuant to Article 10, paragraph 1 of the Consumer Protection Act (Official Gazette 41/14), the consumer has the right to file a complaint at the Seller's business premises, or a written complaint by post or email to the addresses given above. The Seller is obliged to confirm receipt of the consumer's written complaint in writing as soon as possible. To help identify the specific order the complaint concerns, the Buyer should state the order number, invoice number, first and last name, or other information that will help identify the order. In accordance with the law, the Seller will send the Buyer a reply within 15 days of receiving the complaint.
Unilateral withdrawal from the contract
Pursuant to Article 72, paragraph 1 of the Consumer Protection Act, the Buyer is entitled to unilaterally withdraw from the contract without giving any reason within 14 days of the date of delivery of the product and, pursuant to Article 77, paragraph 5 of the Consumer Protection Act, is responsible for any diminished value of the purchased product resulting from its handling.
Limitations on unilateral withdrawal
Pursuant to Article 79, paragraph 1, this limitation applies if performance has begun with the Buyer's express prior consent and their acknowledgment that they will lose the right of withdrawal, and if, pursuant to Article 79, paragraph 3, the subject of the contract is a product made to the Buyer's specifications or clearly personalized. This primarily refers to certain products for which the Buyer chooses the dimensions, shape and color, and to personalized products made to the Buyer's specifications.
Calculating the withdrawal period
To exercise the right of withdrawal, the Buyer must send notice of their decision to withdraw from the contract before the deadline expires, in a written statement giving their first and last name, address, phone number and email address. The withdrawal period begins on the day the Buyer, or a third party designated by the Buyer other than the carrier, takes possession of the product that is the subject of the contract or of the package containing it.
Refund of the amount paid
Refunds are made no later than 14 days from the date of receipt of the Buyer's decision to withdraw from the contract and of the products listed in the decision. The refund will be made using the same method as the payment. A refund can only be made after the product in question has been returned.
Product returns
The Buyer is considered to have fulfilled their obligation on time if they send or deliver the product to the Seller's address before the deadline expires. Products must be properly protected when shipped.
Return shipping costs
The direct costs of returning the product are borne by the Buyer.
Consumer liability for diminished product value
The Buyer is responsible for any diminished value of the product resulting from handling it, other than what was necessary to establish the nature, characteristics and functionality of the product. The Seller determines the diminished value of returned products after receiving and inspecting them and informs the Buyer accordingly.
Terms of use
The website Handmade Corner by Lucy is a web shop owned by the Handmade Corner by Lucy business. The rules and terms set out here apply during its use, as well as all applicable laws. The Seller reserves the right to change these rules and terms at any time and without prior notice. Any such update will be available on the website.
Electronic communication
The Buyer, or potential buyer, enters into electronic communication when visiting the website Handmade Corner by Lucy or when sending email. By doing so, they agree to all rules, warnings, notices and other messages available on the website. The use of invalid email addresses or those belonging to others, or impersonating another person and/or organization, is not permitted. In case of justified suspicion of a false source of information or content necessary to establish a transparent business relationship, the Seller reserves the right to terminate the established relationship.
Consent to the use of personal data
When using the web shop Handmade Corner by Lucy the Buyer, or potential Buyer, acknowledges these terms and conditions and consents to the use of personal data received in electronic communication with the Buyer for the purpose of communication, concluding the contract and delivering the ordered products. The Seller will treat all collected data in accordance with the law and its privacy policy and will not pass them on to third parties or use them for other purposes. If the website needs to store so-called “cookies” on the Buyer's computer, the Buyer will be informed in advance, and they cannot be stored without the Buyer's confirmation.

The web shop Handmade Corner by Lucy and all information, photos and materials displayed on it are the property of the Handmade Corner by Lucy design, production and retail business, are protected by copyright law and may not be reproduced or used without prior written permission.
